Legal recognition of same-sex marriages in South Africa came about as a result of the Constitutional Court 's decision in the case of Minister of Home Affairs v Fourie. The court ruled on 1 December that the existing marriage laws violated the equality clause of the Bill of Rights because they discriminated on the basis of sexual orientation.
